Calcutta High Court judge accuses another of 'misconduct' in judicial order

Justice Abhijit Gangopadhyay of the Calcutta High Court has directed the continuation of a CBI investigation into alleged irregularities in reserved category certificates for medical college admissions, despite a division bench's contradictory order.

Justice Abhijit Gangopadhyay of the Calcutta High Court has accused Justice Soumen Sen, who presided over a division bench that stayed the single-judge order for a CBI probe into medical admission irregularities, of 'misconduct'. Justice Gangopadhyay also directed that the CBI investigation into alleged irregularities will continue.

In his order, Justice Gangopadhyay directed the registrar general of the high court to send a copy of this order to the Chief Justice of India forthwith and to the Chief Justice of the Calcutta High Court.

"Justice Sen is acting clearly for some political party in this State and, therefore, the orders passed in the matters involving State, are required to be relooked if the Hon’ble Supreme Court thinks so," Justice Gangopadhyay said.

"What Justice Sen has done today is to advance the cause of his personal interest to save some political party in power in this State. Therefore, his actions clearly tantamount to misconduct," he added.

The development came while Justice Gangopadhyay was listening to a petition placed before the Calcutta High Court, wherein it was alleged that the issuance of fake caste certificates is rampant in the State and that several persons have obtained such certificates to get admission to medical courses.
